On August 26, 2025, the Regional Court of Frankfurt am Main found Apple’s German advertising claim that the Apple Watch was its “first CO₂-neutral product” misleading under Section 5(1) of Germany’s Act Against Unfair Competition (UWG). Apple must stop using that claim in German marketing. The ruling is not a sales ban, does not require refunds, and does not establish that every Apple Watch has the same emissions profile.
What the Frankfurt ruling actually prohibits
The judgment in case 3-06 O 8/24 concerns a specific commercial representation: “Die Apple Watch ist unser erstes CO₂ neutrales Produkt” (“The Apple Watch is our first CO₂-neutral product”). The injunction applies to advertising in Germany.
- It is an order against a marketing claim, not a prohibition on selling Apple Watch devices.
- It does not calculate a new emissions figure for each watch.
- It does not say that all models, cases, bands or configurations have identical emissions.
- It does not rule that every carbon offset is unlawful.
The court’s press release says the decision was not legally final and could be appealed to the Higher Regional Court of Frankfurt. Any publication update should verify the later appeal record rather than assume the 2025 status remained unchanged.

Which watches were described as carbon neutral?
Deutsche Umwelthilfe (DUH) said Apple had marketed three smartwatch models as CO₂-neutral. Contemporary reporting associated the designation particularly with Apple Watch Series 9 and Series 10, while the exact calculation depended on the selected case and band. The court’s order concerns the advertising representation, not every Apple Watch ever sold.

Apple’s wider environmental disclosures cover manufacturing, electricity, shipping, use and recycling. A product-specific report for bands illustrates Apple’s accounting approach, but it should not be treated automatically as the complete evidentiary record for every configuration in the Frankfurt case. Apple’s September 2024 Apple Watch bands report sets out that framework.
“Carbon neutral” did not mean zero emissions
Apple’s claim used lifecycle accounting. The qualifying watch still generated emissions; contemporary reporting put the total at slightly more than 8 kilograms of CO₂ per watch, which Apple said it balanced with carbon credits and nature-based projects.

The legal question was therefore not whether a watch physically emitted nothing. It was whether Apple could substantiate an unqualified promise that the remaining lifecycle emissions would stay balanced for the period consumers would reasonably expect.
Why the Paraguay project became decisive
Apple relied in part on a project involving eucalyptus plantations on leased land in Paraguay. The Frankfurt court found that leases covering 75% of the project area ran only through 2029. Apple had not shown that all of those leases would be renewed.
For the court, that created a gap between the certainty conveyed by “CO₂-neutral” and the security Apple could demonstrate. Consumers would understand the claim as a continuing emissions balance, not merely as a credit purchase that was valid when the watch was advertised.

DUH additionally characterized the project as commercial eucalyptus monoculture and raised concerns about ecological effects and permanence. Those are DUH’s allegations and advocacy framing; the court’s reported holding focused on the duration and security of the underlying land arrangements.
Why the court looked toward 2050
The court reasoned that an unqualified neutrality claim would lead consumers to expect compensation secured over a much longer period—approximately to 2050—consistent with the long-term climate objective associated with the Paris Agreement. A lease arrangement that was secure for only part of the project through 2029 did not provide that assurance.
This does not mean the court imposed a universal statutory 2050 rule for every environmental claim. It explains how the judges interpreted the consumer impression created by Apple’s particular wording.
Why a Verra buffer account did not cure the problem
Apple argued that a buffer account under Verra’s Verified Carbon Standard protected against uncertainty if leases were not renewed. The court rejected that as equivalent to securing continuation of the project itself.
As summarized by the court, the mechanism could allow monitoring of the affected land and rely on buffer credits if carbon loss occurred later. That is a contingency for loss; it is not the same guarantee as preserving the project and its carbon storage beyond 2029. The distinction matters for any claim that presents future compensation as certain.

What Apple won in the case
The court rejected DUH’s separate argument that Apple’s “Carbon Neutral” logo would be mistaken for an official third-party quality seal. It found that consumers would understand the mark as Apple’s own classification of the product, not as a government or independent certification.
The ruling therefore did not condemn every visual or textual element of Apple’s environmental presentation. The specific unqualified product claim was the part found misleading.
What Apple said
Apple told TechCrunch that the court had “broadly upheld” its approach to carbon neutrality, even though the specific advertising claim was prohibited. TechCrunch’s report also describes the emissions-and-offset structure.
German coverage reported that Apple connected later changes to its environmental marketing with an upcoming European Union rule on climate claims. The exact legislation, effective date and scope should not be inferred from that report alone. Tagesschau’s coverage provides that context.
What the ruling means for Apple Watch buyers
No sales ban
The decision does not stop Apple from selling Apple Watch in Germany. It restricts the challenged advertising wording.

No automatic refund
The cited competition-law judgment is not a damages award or a ruling that every customer is entitled to repayment. It establishes no automatic refund remedy.
Environmental data and marketing language are different
Apple can still publish lifecycle data, describe emissions reductions or explain a project, subject to applicable law. The court found that the broad “CO₂-neutral product” promise was misleading given the insecurity of the offset arrangement; it did not find that every underlying emissions estimate was false.
How to evaluate any “carbon-neutral” product claim
- Define the term. Ask whether “neutral” means zero operational emissions or compensation for a lifecycle balance.
- Check the boundary. Identify whether manufacturing, transport, electricity, use, repairs and end-of-life are included.
- Identify the action. Separate reductions made within the company from purchased credits or removals elsewhere.
- Examine project type. Determine whether credits represent avoided emissions, removals or forestry storage.
- Test durability. Ask how long carbon is expected to remain stored and who controls the land.
- Read the failure plan. Find out what happens after a fire, harvest, contract termination or reversal.
- Understand buffers. A reserve account may address some losses, but it may not guarantee that the project itself continues.
- Check certification. Establish whether an independent standard verified the credits or the label is solely the seller’s description.
- Check geography. A claim may be lawful or restricted in one market without creating a worldwide rule.
Why the case matters beyond Apple
The Frankfurt decision illustrates a broader greenwashing risk: a claim can be challenged because its future conditions are uncertain, even when a company has reduced emissions and purchased credits. Marketing must match what the evidence can guarantee over the period consumers infer.
That is especially relevant to forestry projects dependent on leases, future renewals or storage that can be reversed. The ruling did not hold that eucalyptus plantations cannot store carbon, or that all offsets are invalid. It held that Apple had not demonstrated a sufficiently secure and long-term basis for this particular unqualified claim.
