Short answer: A German court did not find that Apple Watches produce no environmental benefits or that Apple fabricated its emissions calculations. It ruled that Apple could not advertise certain Apple Watch models as “CO₂-neutral” in Germany because the carbon-credit projects used to balance the remaining emissions were not shown to provide sufficiently durable compensation.
The case is about the substantiation of an environmental marketing claim—not a ban on selling, owning or using the Apple Watch.
What the Frankfurt court decided
On August 26, 2025, the Regional Court of Frankfurt am Main ruled against Apple in a case brought by Deutsche Umwelthilfe, a German environmental and consumer-protection organization. Reporting on the decision says Apple was required to stop or change the challenged “carbon-neutral” Apple Watch advertising in Germany unless the ruling was successfully appealed. ESG Dive’s account of the ruling describes the dispute as an advertising and consumer-deception case.
That distinction matters. The court did not establish that every Apple Watch has the same carbon footprint, that Apple’s emissions-reduction work is worthless, or that every carbon credit is invalid. The narrower conclusion was that Apple had not adequately supported a broad consumer-facing claim with the particular offset arrangements at issue.

The precise procedural status of any appeal, and the full enforcement timeline, should not be assumed from the ruling alone.
Why the “carbon neutral” claim was challenged
Apple’s product calculations leave residual emissions after reductions in materials, manufacturing electricity and transportation. Apple then applies carbon credits intended to compensate for that remainder.
The reported problem concerned the durability of the forest-related projects behind those credits. Approximately 75% of the relevant Paraguayan projects were reportedly leased only until 2029. The court considered that period too uncertain for a product claim that consumers could understand as promising durable compensation for climate pollution lasting far longer.
This is the permanence problem in simple terms: protecting or storing carbon in a forest only delivers the claimed climate benefit if the carbon remains stored—or the threatened emissions remain avoided—for the relevant period. If a land-use agreement expires, the forest may remain protected, but the credit holder cannot necessarily guarantee that outcome.
The court reportedly considered the much longer time horizon that consumers could associate with climate neutrality and the Paris Agreement’s 2050 benchmark. That does not mean the Paris Agreement legally requires every product offset to last until 2050. It means the court questioned whether the evidence supported the expectation created by Apple’s wording.
Apple’s own reports show that the watch still creates emissions
“Carbon neutral” does not mean that no emissions occur while a watch is manufactured, shipped, used or discarded. It means that a company’s accounting model claims to balance estimated emissions with reductions and credits.
Apple’s 2024 Apple Watch SE Product Environmental Report provides a useful example for a specified configuration:

The important phrase is “after credits.” The watch did not emit zero greenhouse gases. Apple estimated its life-cycle emissions, reduced them through product and supply-chain changes, and then applied credits equal to the modeled remainder.

Apple also says these calculations contain uncertainty arising from data limitations, industry averages and assumptions. The report describes a life-cycle assessment methodology that refers to ISO 14040, ISO 14044 and ISO 14067. A documented methodology can make a calculation more transparent; it does not automatically guarantee that every underlying forest project will deliver permanent climate benefits.
What Apple says it changed
Apple introduced its first products described as carbon neutral in September 2023. According to its announcement, the initial Apple Watch products achieved more than 75% emissions reductions through changes to materials, electricity and transportation.
Apple said its initial criteria included:
- Clean electricity for manufacturing and product use;
- At least 30% recycled or renewable material by weight; and
- At least 50% non-air shipping.
The original announcement did not cover every Apple Watch. It identified aluminum Series 9 models paired with a new Sport Loop, and Apple Watch Ultra 2 models paired with a new Trail Loop or Alpine Loop.

For example, Apple’s Series 10 report describes a U.S. GPS + Cellular configuration with a titanium case and Milanese Loop as carbon neutral. The claim can therefore depend on the case material, size, cellular option, band, use assumptions and market.
The court’s concern was not that every offset is worthless
Carbon credits are not interchangeable with physically removing the exact emissions produced by one particular watch. Depending on the project, a credit may represent:
- Avoided emissions: emissions that a project claims would otherwise have occurred;
- Forest protection: preventing deforestation or degradation;
- Reforestation or new storage: increasing the amount of carbon held in vegetation or soil; or
- Carbon removal: taking carbon dioxide from the atmosphere and storing it for a stated period.
A forest-protection credit is not automatically a carbon-removal credit. Each project also raises questions about additionality, leakage, monitoring, ownership and permanence:
- Additionality: Would the climate benefit have happened without the credit revenue?
- Leakage: Did protecting one area simply shift deforestation elsewhere?
- Monitoring: Can the claimed outcome be measured and checked?
- Ownership: Who has the legal right to claim the benefit?
- Permanence: How long is the carbon benefit protected?
The reported Frankfurt reasoning focused particularly on permanence and the limited duration of the relevant land arrangements. It did not amount to a universal finding that all forest projects, all credits or all carbon accounting are invalid.
What the ruling did not decide
The decision should not be paraphrased as “the court proved Apple Watches are not carbon neutral” without qualification. It did not necessarily decide that:

- Apple’s emissions calculations were fabricated;
- Every carbon credit Apple has purchased is invalid;
- Every Apple Watch configuration has a 7.2 kg CO₂e footprint;
- Recycled materials, renewable electricity or lower-emissions shipping provide no benefit;
- Carbon accounting is impermissible;
- No product could ever legally be described as carbon neutral; or
- The Apple Watch is environmentally worse than a comparable product.
A competitor comparison would require consistent product boundaries, configurations, expected lifetimes, electricity assumptions and treatment of offsets. The ruling does not provide that comparison.

Apple has said the court broadly upheld its rigorous approach to carbon neutrality. Apple’s reports also include detailed boundaries, configuration assumptions, emissions categories and credit quantities, and some declarations were assessed under third-party programs.
That evidence supports a more nuanced conclusion: Apple appears to have made substantial modeled reductions before applying credits, but certification of a methodology or declaration is not the same as a guarantee that every underlying forest project will remain effective indefinitely. The court’s decision illustrates how a calculation can be technically documented yet still fail a consumer-advertising test if the headline claim promises more certainty or durability than the supporting evidence establishes.

Buyers in Germany
Apple may need to remove or revise the relevant “carbon neutral” wording in German advertising and retail materials, subject to the case’s procedural status. The ruling does not make existing watches illegal, stop them working or automatically entitle owners to refunds.
When evaluating a watch, treat the environmental label as only one part of the evidence. More concrete questions include:
- How long will the device remain useful and supported?
- Can its battery or other components be serviced?
- How much recycled material is used in the exact configuration?
- What life-cycle footprint does Apple report before credits?
- What type of credit is used for the remainder?
Buyers elsewhere
A German advertising judgment is not automatically a worldwide product ban. Apple’s wording can differ by country, model and date, and German advertising law does not directly determine the legality of Apple’s U.S. marketing.
The decision may nevertheless influence regulators, courts and consumer organizations elsewhere. EU rules concerning environmental marketing are also relevant context. Reports have said that rules affecting certain offset-based “carbon neutral” claims were expected to apply from September 2026, but the exact application and national implementation position should be checked against current EU and national legal sources rather than inferred from older coverage.
How to assess a carbon-neutral product claim
- Start with absolute emissions. Find the estimated life-cycle footprint before offsets or credits.
- Separate reductions from compensation. Ask how much came from materials, manufacturing energy, shipping and design, rather than credits.
- Identify the credit type. Avoided emissions, forest protection, reforestation and durable removal are different claims.
- Check permanence. Look for the contractual protection period and what happens if the project fails.
- Check additionality and verification. Find out whether the project needed credit revenue and who assessed it.
- Check the exact configuration. Case, size, band, cellular capability, region and expected lifetime can all matter.
- Read the uncertainty statement. A product figure is a modeled estimate, not a direct measurement of every individual device.
- Compare the headline with the footnote. If “carbon neutral” sounds permanent and absolute but the evidence is conditional, the wording may overstate what has been established.
Carbon neutral, net zero and carbon negative are not synonyms
- Carbon footprint
- The estimated greenhouse-gas emissions associated with a product, activity or organization, usually expressed as carbon-dioxide equivalent.
- Carbon neutral
- A claim that emissions have been balanced by reductions, credits or removals under a stated accounting boundary. The term does not by itself say that no emissions occurred.
- Offset
- A credit representing a claimed reduction, avoidance or removal elsewhere. Its quality depends on the project and accounting rules.
- Carbon removal
- The physical removal of carbon dioxide from the atmosphere and its storage for a stated duration. Not every forest credit is a removal.
- Net zero
- Usually an organization-wide goal involving deep emissions cuts before balancing residual emissions. It should not be treated as interchangeable with a product-level carbon-neutral label.
The practical bottom line
Apple’s environmental reports support the claim that it has reduced much of the modeled emissions associated with certain Apple Watch configurations. They do not show that manufacturing, shipping, use and disposal produce no emissions. The remaining emissions were balanced through credits, and the Frankfurt court found that the durability of the relevant forest projects was not adequately established for the advertising claim.
So the precise conclusion is not that the Apple Watch is “illegal” or that Apple’s entire environmental program is fraudulent. It is that Apple could not substantiate its broad carbon-neutral marketing claim in Germany under the facts presented to the court. For consumers, the sensible response is to look beyond the label: prefer long device lifetimes, repair and reuse where practical, and treat offsets as a separate and more uncertain part of the environmental calculation.
