The court focused on whether the carbon-offset project Apple relied on was secured for long enough—not on the quality of the watch or on whether all carbon credits are invalid. The ruling also did not prohibit Apple’s “Carbon Neutral” logo on the separate ground that it resembled an official quality seal.
What did the Frankfurt court decide?
In case 3-06 O 8/24, the Landgericht Frankfurt am Main ordered Apple to stop the challenged Apple Watch carbon-neutral product advertising. It found the representation misleading under § 5(1) of Germany’s Unfair Competition Act (UWG). The decision was announced on 26 August 2025 in the court’s press release.
The dispute was about the impression the advertising could create for consumers considering an Apple Watch: that the product’s emissions were compensated through a project whose climate benefit would remain secured over a sufficiently long period. It was not a general ruling that every Apple climate statement, every carbon credit, or every product marketed with an environmental claim is unlawful.
Why did the court question Apple’s Paraguay offsets?
Apple relied on a eucalyptus-plantation project on leased land in Paraguay as part of its compensation. According to the court, leases covering 75% of the project area ran only until 2029, and Apple had not established that all those leases would be renewed. The court considered that consumers could expect the compensation to remain secured to around 2050, taking account of the Paris Agreement’s temperature goal and the long persistence of carbon dioxide in the atmosphere.

The roughly 2050 horizon was the court’s assessment of consumer expectations in this case. It is not a general statutory deadline requiring every offset project to be retained until that year.
Why the buffer account was not enough
Apple pointed to a buffer account under Verra’s Verified Carbon Standard (VCS). The court considered an arrangement in which the land would be monitored after lease expiry and the buffer mechanism used only if the project were lost. It concluded that this contingency did not provide an equivalent assurance that the forest project itself would continue beyond 2029.

In other words, the issue was not simply whether a mechanism might respond if the project failed. The court found that the advertising claim could imply durable compensation, while the continuation of much of the underlying project area was not shown to be secured for the period consumers could expect.
Did the ruling ban Apple’s “Carbon Neutral” logo?
No—not on the separate argument that the logo might be mistaken for an official quality seal. The court rejected that objection, treating the logo as Apple’s own indicator of how it classified a product rather than a seal guaranteeing product quality. That partial result does not undo the finding against the challenged carbon-neutral product advertising.

Is the ruling final, and did Apple appeal?
When the court announced its decision on 26 August 2025, it said the judgment was not legally final and could be appealed to the Oberlandesgericht Frankfurt am Main. The cited court release does not establish whether Apple later appealed or what happened afterward, so the procedural status should not be inferred from that announcement alone.
The court’s release also does not set out the precise model-by-model scope of the operative order. A contemporaneous Tagesschau report described three watches as affected, but that secondary account is not a substitute for the full judgment when determining exactly which products or advertisements the order covers.

What Apple’s environmental report does—and does not—show
Apple’s 2025 Environmental Progress Report includes certification information for a specified Apple Watch Ultra 2 configuration and period. That corporate reporting context does not override the Frankfurt court’s ruling: the court addressed the challenged advertising claim and the evidence about the duration of the Paraguay project. Any conclusion about a particular configuration’s certification requires checking the report’s exact scope and wording.
