Hamilton International, the watch brand, opposed the application. 44IP then sought to have Hamilton International’s trademark declared invalid, arguing that it had been registered in bad faith. The reported challenge failed.
A 2022 overview by legal-industry publisher Novagraaf describes the same sequence: Hamilton International opposed the application, followed by a bad-faith nullity challenge against the watch company’s registration. It likewise characterizes the challenge as unsuccessful.
Was it a court case?
No court judgment is established by the cited accounts. They describe a trademark proceeding before EUIPO, the European Union agency responsible for registering EU trademarks and designs. Although the 2020 headline calls the outcome a “legal battle” and its story uses court-related phrasing, the reported decision-maker was EUIPO. Why did 44IP’s challenge fail?
According to Time+Tide, the argument that Lewis Hamilton’s intellectual-property rights justified cancelling the watch brand’s mark was rejected. The article reproduces this wording as EUIPO’s: “The argument relating to the IP rights of the racing driver Lewis Hamilton fails.” It also attributes to EUIPO the statement: “There is no ‘natural right’ for a person to have his or her own name registered as a trademark, when that would infringe third parties’ rights.” These are quotations as reproduced in secondary reporting, rather than wording independently checked against the original EUIPO decision.
How did Hamilton watches’ history factor into the story?
Both Time+Tide and Novagraaf report that Hamilton had been producing watches under the Hamilton name since 1892, decades before Lewis Hamilton was born.
