When you buy jewellery from a dealer acting as a trader, the Consumer Rights Act 2015 generally requires it to be of satisfactory quality, fit for any purpose you made known to the seller, and as described. Separate rules govern precious-metal hallmarks, while your right to return a non-faulty item depends largely on whether you bought it in a shop or through a distance-sale contract. These protections differ for private sales and some auctions.
First check whether you bought from a trader
The Consumer Rights Act protections discussed here apply to relevant trader-to-consumer purchases. A dealer selling jewellery as part of a business is generally a trader; someone selling a personal item privately is not generally treated as one. The facts matter, particularly where an auction is involved. The Act has a special rule for second-hand goods sold at public auction where individuals have the opportunity to attend in person, so do not assume every auction purchase is covered in the same way as a shop purchase. Consumer Rights Act 2015, section 2

If the seller is based outside the UK, enforcing your rights may be more difficult in practice. Check the trader’s location before ordering; the UK government’s hallmarking consumer guidance notes this enforcement difficulty.
What quality and description must a dealer meet?
Under the Consumer Rights Act 2015, goods must be of satisfactory quality, fit for a particular purpose made known to the trader, and as described. For jewellery, the description may include the metal and its fineness, the stones and whether a stone is natural or lab-grown, the item’s condition, dimensions, or stated age and provenance. Relevant pre-contract information can also matter to the contract; preserve the listing and messages rather than relying only on what you remember being said. The Act states: “Every contract to supply goods by description is to be treated as including a term that the goods will match the description.” Consumer Rights Act 2015, section 11

Second-hand jewellery
These standards also apply when you buy second-hand jewellery from a dealer, but satisfactory quality is judged in context. Age, price, the item’s description and any condition disclosed before purchase all matter. A used piece need not be in new condition, and a clearly disclosed defect is not automatically grounds for a remedy. Keep evidence of what the dealer told you about the piece.
What the law does not guarantee
A hallmark is not a certification of a gemstone, age, provenance, maker, total value or freedom from damage. Nor does a statement about value automatically establish that the item is worth that amount; the transaction’s description and evidence matter. For a valuable purchase, you may choose to seek an independent valuation or specialist assessment, but neither is a legal prerequisite.

What remedies are available if jewellery is faulty or misdescribed?
If the jewellery does not meet the statutory standards, remedies can include a short-term right to reject, repair or replacement, and—if the statutory conditions are met—a price reduction or final rejection. The appropriate remedy depends on when the problem arises and the circumstances. The short-term right to reject is normally available for 30 days, subject to the Act’s rules. Your statutory claim is against the seller; it is not automatically a claim against the manufacturer. A voluntary guarantee may add protection, but it does not replace statutory rights. Hallmarking law regulates descriptions of precious-metal articles. If a trader describes an item as gold, silver, platinum or palladium, it generally needs a hallmark unless an exemption or other exception applies. The main weight exemptions listed in the UK government’s hallmarking summary are:

These are not the only possible exceptions. Palladium is also regulated, but its threshold and other exceptions are not set out here; consult the current full guidance before relying on a threshold. Recognised convention marks may be accepted in the UK. See the government’s hallmarking guidance summary and consumer protection guidance.
A hallmark concerns precious-metal identity and fineness within the hallmarking system; it does not establish the other qualities of the piece. Marks can be tiny, so ask to inspect the item with magnification if needed. Shops must display a Dealer’s Notice, and hallmarking law also applies to online purchases.

Can you return jewellery if you change your mind?
If you bought it in a shop
For a non-faulty item bought in person, there is generally no automatic statutory right to return it just because you changed your mind. A dealer may offer a refund or exchange under its own policy, so check the written terms before paying and keep them. This does not remove your rights if the jewellery is faulty, unfit for purpose or not as described. UK government guidance on returns and refunds

For most qualifying distance contracts, you can cancel without giving a reason up to 14 days after delivery. After notifying the trader, you generally have a further period to return the goods. The trader must provide required pre-contract information, including cancellation information. Clearly personalised or made-to-your-specification goods are exceptions to this change-of-mind cancellation right; faulty-goods rights remain separate. A ring ordered in a standard size is not necessarily personalised just because it is ordered in, so the actual specification and circumstances matter. Check the trader’s terms if the order is bespoke. UK government guidance on online and distance selling

How to protect yourself before buying
- Check whether the seller is a business or a private individual, and note where the trader is based.
- Save the listing, receipt or order confirmation, and messages describing the metal, stones, condition, dimensions or provenance.
- Ask where the hallmark is and what it signifies. Use magnification to view a small mark; a magnifier helps you see it but does not authenticate the jewellery.
- For a shop purchase, read the written change-of-mind return policy. For an online bespoke order, check whether the cancellation exception may apply.
- Keep any valuation or certificate as evidence of what was represented, while remembering that it is not a substitute for the item matching its contract description.
What to do if something is wrong
- Keep evidence. Save proof of purchase, the original listing and messages, photographs of the item and hallmark, and any valuation or certificate.
- Contact the dealer in writing. Describe the fault or mismatch, when you noticed it, and the remedy you are seeking. Include relevant dates and copies of supporting evidence.
- Do not alter or repair the item first. Raise the issue with the seller before arranging work, so the condition and dispute are documented.
- Seek consumer help if needed. Contact Citizens Advice about the dispute. If you suspect a trader has unlawfully sold unhallmarked precious-metal jewellery, report it through your local authority’s Trading Standards route. The government explains these routes in its hallmarking consumer guidance.
