Consumer EEG headbands are not all alike. A passive EEG device reads electrical activity at the scalp; a device that stimulates the brain is a different category and needs a separate safety assessment. For passive headbands, safety claims depend on the model and come from its maker, while the data collected can include EEG, other body signals, derived wellness measures, and app or account activity. Check the specific device’s instructions and privacy disclosures rather than assuming every wearable behaves the same way.
What “safe to use” can—and cannot—mean
For passive EEG headbands, the sensor reads electrical signals at the scalp rather than intentionally sending energy into the body. Neurosity describes its Crown electrodes this way, but that is a statement about that product, not a general guarantee about every brain-sensing wearable. Its guide also notes that 20-year longitudinal studies of daily consumer EEG use are lacking. Neurosity’s EEG safety guide

Makers’ safety statements should be treated as product-specific claims, not independent proof of safety across brands, models, users, or usage patterns. For example, Muse says its devices have been tested and certified against standards it identifies as FCC, UL, and CE. The company also advises users who experience discomfort or pain to stop using the device and contact support. Muse Health and Safety
Fit, age guidance, and skin contact
Fit and contact matter for a wearable worn against the head. Muse recommends its devices for ages 16 and up, citing privacy considerations and adult headband fit. Separately, its terms generally require people to be at least 13 to use its software and products, subject to jurisdictional exceptions. A minimum account age is not the same as a product-fit recommendation. Follow the instructions for the exact model, check contact materials if you have known sensitivities, and stop use if wearing it causes pain or discomfort. Muse Health and Safety · Muse legal terms

Passive sensing is not brain stimulation
An EEG recorder and a device designed to stimulate the brain should not be grouped together for safety purposes: one senses signals, while the other has a different function and risk profile. The sources here address consumer EEG sensing; they do not establish the safety of stimulation devices. Check a product’s intended use and instructions instead of inferring its function from the phrase “brain-sensing wearable.”
What information can a brain-sensing wearable collect?
“Brain data” may include raw or processed EEG, but a device ecosystem can also collect other sensor readings and information generated by its app. The categories below are vendor-specific disclosures, not a checklist of what every headset collects.

Muse: EEG, other sensors, and app activity
Muse defines sensor data to include EEG brainwave patterns, heartbeat patterns measured by PPG, movement, UV, battery status, temperature, and pressure. It also describes processed measures such as heart rate, heart-rate variability, and breath rate; activity or session data; preference data; and transmission logs, including sync timing, app-use duration, and device IP address. Its legal page says the mobile app records, processes, and stores activity, sensor, preference, processed, and transmission data. Muse legal terms

AI features can add conversation and interaction data
Muse’s legal page defines conversational data for its AI Coach as text or voice transcripts and related metadata, including timestamps and session identifiers. Its help page says Enso uses EEG/fNIRS signals, session history, profile and app usage, and user interactions to personalize the service. These feature disclosures make it important to check the current policy for the feature you actually use. Muse legal terms · Muse Data and Privacy
EMOTIV: EEG, telemetry, and derived measures
EMOTIV defines EEG data broadly to include electrical biosignals, sensor telemetry, motion outputs, and derived metrics. Its help article says EEG data is stored in EMOTIV Cloud and may be used in anonymized form for research and algorithm development. EMOTIV says it does not sell community data to third parties without explicit permission. These are the company’s disclosures; they should not be taken as an independent assessment of how data is protected or whether anonymized data could ever be linked back to a person. Where the data goes—and what to check before buying
Data handling differs by product and feature. Neurosity says Crown performs core processing on-device and uses hardware-level encryption. Muse and EMOTIV describe app and cloud services in their materials. These vendor statements are not directly interchangeable: on-device processing does not by itself explain every data flow, and cloud storage does not specify every setting or retention period. Check the current disclosures for the exact model and features you plan to use. Neurosity’s EEG safety guide · Muse legal terms · EMOTIV data storage and privacy
- Data leaving the device: Does the product send raw EEG, processed measures, or both to a phone or cloud service?
- Identity and account links: Can sessions be linked to your account, profile, device identifiers, or app activity?
- Research and third parties: Is research participation optional, what does consent cover, and how do you opt out or withdraw? Which processors or partners receive data?
- Retention and control: How long is information retained, and can you access, export, or delete it?
- Extra features: Do AI or coaching functions process voice, text, or interaction history? Where is data stored, and how are legal requests handled?
Encryption can reduce some risks but does not answer every question about collection, access, retention, or sharing. Likewise, “anonymized” is a description used by a company, not a guarantee that re-identification is impossible.

Keep website advertising disclosures separate from headset data practices. Muse’s privacy-choices page says personal information from website interactions may be shared with advertising partners and describes an opt-out mechanism for certain U.S. state-law rights.
