Police can seize a watch linked to suspected fraud, but possession of an expensive watch is not by itself proof of wrongdoing, and seizure does not mean the police own it. The legal route matters: a watch might be held as evidence, detained under a proceeds-of-crime power, or later become subject to a court’s confiscation, civil recovery or forfeiture process. The rules differ across the UK, so the first practical step is to ask the officer in the case which power is being used and why the watch is still held.
When can police seize a watch?
Under the Proceeds of Crime Act 2002 (POCA), watches are expressly included in the category of “listed assets”. That label does not make every watch seizable. The listed-asset search and seizure route requires statutory conditions to be met, including a relevant connection to recoverable property or intended unlawful conduct and the applicable minimum value. The Home Office code does not supply a safely quotable current numerical threshold, so no single figure should be assumed from this explanation. The Home Office code for listed-asset searches explains the route and its safeguards.

Officers’ suspicion must have an objective basis in relevant facts, information or intelligence, and they should be able to explain it. The code rejects suspicion based only on personal characteristics, stereotypes or a prior conviction. A watch’s price, brand or mere presence on someone’s wrist does not, on its own, establish a link to fraud or criminal property.

The listed-asset procedure is a specific POCA route, not a general power to take any valuable watch. The code describes procedural steps before a search and requires a record of its outcome, the asset’s description and any explanation given about its ownership, origins, purpose or destination. A person should be told they are entitled to a record. If an electronic copy cannot be provided immediately, the code describes providing a receipt and explaining how to obtain the record.

Property relevant to confiscation
In England and Wales, separate POCA provisions address searches, seizure and detention of property relevant to confiscation. The Home Office code covering sections 47B–47S describes those powers and their safeguards. This route is distinct from a search for listed assets; the applicable power depends on the facts and purpose of the action.
Seizure, evidence and final recovery are different stages
A watch taken during an investigation may be retained because it is relevant evidence, or under a power connected to asset recovery. Either can happen before a court decides whether anyone committed an offence or whether the watch is recoverable. Retention is not the same as final confiscation or a finding that the watch is criminal property.

Final recovery can follow different legal routes. The decision-maker, purpose and whether a criminal conviction is needed vary:

|---|---|---|
| Evidence retention | Not necessarily; the watch may be held during an investigation or case. | Preserves material for an investigation or proceedings. The applicable police powers and conditions govern retention; it is not itself a final asset-recovery order. |
| Confiscation | Yes. It follows a criminal conviction. | A court makes a confiscation order intended to deprive the defendant of criminal benefit so far as within their means. Police do not decide final confiscation unilaterally. See the CPS guidance on proceeds of crime. |
| Civil recovery | No. It may be considered whether or not there is a criminal investigation or prosecution, and regardless of its stage. | A civil-court process for recovering property alleged to be criminal property. College of Policing guidance describes the civil standard as the balance of probabilities. See its asset-recovery overview and the CPS guidance above. |
| Forfeiture | It depends on the specific statutory procedure; it is not automatic simply because a watch was seized. | A separate legal route with its own conditions and decision-maker. The CPS may represent law enforcement in specified forfeiture proceedings; the applicable procedure must be identified for the case. |
The distinction matters to an owner or anyone with an interest in the watch: the process that allowed officers to take or hold it does not, by itself, decide who ultimately owns it or whether it can be recovered.

Does the process work the same way across the UK?
No. The Home Office’s June 2021 code for listed assets says it applies to section 303C searches in England and Wales and Scotland, while Scotland and Northern Ireland have separate codes. The Home Office’s April 2024 code on search, seizure and detention under sections 47B–47S is specifically for England and Wales. A rule or procedure described for one route or jurisdiction should not be treated as a UK-wide timetable or guarantee.
The codes guide officers but do not replace legislation or authoritative court decisions. The Home Office says: “Only the courts can give an authoritative interpretation of the legislation.” The listed-assets code also says officers must comply with their mandatory statutory obligations. The June 2021 code warns that it is not a complete or authoritative statement of law and that subsequent legal developments may affect it.

When can you get a seized watch back?
There is no single return deadline established for every force, legal power or case. A watch held as evidence may remain with police while the investigation or proceedings continue, and property may in some cases be retained after conviction. Leaving custody or reaching the end of a hearing does not necessarily mean it is ready for collection.
West Yorkshire Police’s public guidance says to contact the officer in the case and wait for authorization before collecting property; it advises against turning up without notice. That is one force’s guidance, not a universal statutory timetable. Its public page uses the practical question, “I was arrested and the police took my property, when can I get it back?” and includes a watch as an example of property taken from someone’s pockets. See West Yorkshire Police’s guidance on getting property back.

What to do if your watch has been taken
- Keep the paperwork. Save the seizure or property reference and any receipt, inventory or record given to you. The listed-asset code describes an entitlement to a record of the search and its outcome.
- Contact the officer in the case. Ask which legal power or process is being used, whether the watch is being retained as evidence or under an asset-recovery power, and what stage the matter has reached.
- Ask what is required for a return request or ownership claim. Find out who can authorize collection, how to make the request and whether a separate court process is underway. Do not assume a receipt, serial number or invoice alone will secure return.
- Get case-specific legal advice if ownership or recovery is contested. This is especially important if you are a third party claiming an interest, or if confiscation, civil recovery or forfeiture is being pursued. The relevant rights and procedure depend on the facts, jurisdiction and legal route.
