If you think a pre-owned watch was sold as genuine but is counterfeit, save the listing and transaction evidence, get a written assessment if practical, and contact the seller promptly. Then open the marketplace’s counterfeit or “not as described” process before its deadline and check your payment provider’s rules before pursuing overlapping claims. The steps below focus on U.S. guidance; your rights and deadlines depend on your location, seller, marketplace and payment method.
1. Preserve the listing and transaction evidence
Save records before the listing disappears or your account access changes. The Federal Trade Commission (FTC) advises consumers to keep copies of messages with the seller and marketplace and to check the site’s claim and return deadlines. FTC online-shopping guidance also supports keeping the transaction details together.

- A screenshot or copy of the full listing, especially claims that the watch is authentic, genuine or original.
- Your receipt, order confirmation, payment record and shipping documents.
- Messages with the seller and marketplace, including any statements about authenticity or a proposed return.
- Clear photographs of the watch, packaging, serial or reference markings and any visible discrepancies. Do not alter, repair or discard the watch or its packaging while the claim is unresolved.
Keep communications in writing where possible. Make a dated note of when you received the watch and when you first raised the concern.
2. Get an assessment you can document
If practical, ask the watch brand, an authorized service center or a qualified independent watchmaker whether they can inspect the watch and provide their findings in writing. Before authorizing work, ask what the assessment covers, what it costs and whether it could alter the watch or its identifying marks. Request an itemized receipt or written report and retain it with your evidence.

There is no universal authentication standard established by the consumer guidance cited here, and an inspection should not be described as guaranteed proof. A written, technically specific assessment may help explain your concern to the seller or platform, but follow the claim process’s evidence requirements.
3. Ask the seller for a refund in writing
Contact the seller promptly. The FTC’s general advice for marketplace problems is to contact the seller first; if that does not resolve the issue, contact the marketplace. Read the FTC’s online-shopping guidance.
Keep the message factual and concise. Identify the order, quote the listing’s authenticity claim, explain why you believe the watch is counterfeit, attach or offer relevant evidence, and request a refund. Ask for written return instructions before shipping anything back. Do not send the watch to an address supplied outside the platform’s process unless you have verified that doing so will not affect your claim.
4. Open the marketplace claim before its deadline
Use the platform’s counterfeit or “not as described” process and follow its instructions for evidence, return shipping and timing. Deadlines and eligibility vary, so check the current policy for the marketplace and country where you bought the watch.

For U.S. eBay transactions, its Money Back Guarantee policy describes a covered situation where “There are strong indicators that the item is counterfeit.” That wording is not a guarantee that every authenticity disagreement qualifies; the policy terms and the facts of the case matter. Review the current eBay Money Back Guarantee policy and submit evidence through the case process.
5. Check the payment provider’s dispute process
Contact the card issuer or payment service promptly, explain that the watch was represented as genuine but appears counterfeit, and ask which dispute route and deadline apply to your transaction. Describe the facts accurately; the provider decides whether the claim fits its rules.
For U.S. credit cards, the FTC distinguishes disputes about the quality of goods from billing errors. The 60-day written-notice rule applies to qualifying billing errors; it is not a universal deadline for counterfeit-watch claims. Do not assume that opening every available claim at once is harmless. eBay warns that seeking payment-provider relief for the same transaction may affect an eBay Money Back Guarantee case. PayPal says eligible buyers may dispute an item that is fake and recommends contacting the seller first. Review the current terms for both routes before choosing how to proceed:
- eBay Money Back Guarantee policy
- PayPal guidance for an item that differs from what was ordered or is faulty
Ask each provider whether pursuing another route, accepting a refund or returning the watch will change your eligibility. Keep the watch until the provider or platform gives clear written return instructions.

You can report suspected scams to the FTC and consider contacting your state consumer-protection office. The FTC explains how to report fraud; USA.gov provides guidance on contacting your state consumer-protection office. A report helps authorities collect information but does not itself guarantee a personal refund. Ask your payment company whether a payment can be reversed.
The INFORM Consumers Act includes marketplace seller-verification and suspicious-activity provisions, but those provisions do not by themselves guarantee an individual buyer a refund. See the FTC’s INFORM Consumers Act guidance.

If the seller or platform asks you to return the watch
Follow the marketplace or payment provider’s written instructions, not informal directions that could conflict with an open case. Confirm the return address, shipping method, tracking and any insurance requirements before sending it. Keep copies of the instructions and proof of shipment, and do not ship the watch until you understand how the return affects your claim.
When the purchase was outside the United States
The official guidance linked here is primarily U.S.-focused. Consumer remedies, reporting channels and dispute deadlines differ by country and may also depend on whether the seller was a business or a private individual. Check the applicable local consumer-protection authority and the current terms of your marketplace, card issuer or payment service rather than assuming U.S. rules apply.
