The steps for recovering property from a pawnbroker vary by location, so use the process where the watch is being held rather than assuming another jurisdiction’s rules apply.
First, establish what happened and preserve your evidence
Ask the shop owner or manager for a written account of when the watch went missing, what happened to it, and whether it was transferred or pawned. If there was a pawn transaction, ask for any identifying details the shop can provide, such as the pawnbroker’s name, location, and transaction date.

Gather and preserve:
- The repair order, receipt, payment record, and any paperwork describing the agreed work.
- Proof of ownership, such as a purchase record, insurance documentation, or other records that identify the watch as yours.
- Photographs and identifying details, including brand, model, serial number, distinctive features, and any accessories handed over with it.
- Messages, emails, letters, and notes of calls or in-person conversations. Record dates, names, what was said, and any promised follow-up.
The FTC advises consumers to collect transaction documents, keep notes of contacts, and retain copies of letters and supporting records. See the FTC’s guidance on solving a consumer problem.
Make a clear written demand to the repair shop
Write to the shop owner or manager. Identify the repair transaction and watch as precisely as you can, summarize what the shop has told you, and state the outcome you want: return of the watch or a specific compensation proposal. Give a reasonable date for a response. There is no single demand-letter deadline established for every location; local law may impose different notice requirements.

If the shop says it pawned the watch, contact local police promptly
Tell local police that the repair shop says it transferred or pawned your watch without your permission. Provide the watch’s identifying information and proof of ownership, and ask what report and property-recovery procedures apply. Ask the pawnbroker, without confrontation, what documentation is needed to identify or flag the specific watch. Do not assume that a report guarantees seizure or immediate return: the available official procedures are jurisdiction-specific.

Florida: statutory notice and court petition process
Under section 539.001(15) of the 2025 Florida Statutes, a claimant seeking possession of purchased or pledged goods claimed as misappropriated must notify the pawnbroker either by certified mail with return receipt or in person with a signed receipt. The notice must accurately describe the goods and include a legible copy of the applicable law-enforcement agency report. If the matter is unresolved within 10 days after the pawnbroker receives notice, the claimant may petition a court for return; the pawnbroker must hold goods described in the petition pending resolution. This is a Florida-specific procedure, not a general rule for the United States.

New South Wales Government guidance says to report suspected stolen or unlawfully dealt-with goods to police and provide documentary proof of ownership or a statutory declaration. Police may issue a Restoration Notice. The pawnbroker then has 28 days to return the goods or apply to the NSW Civil and Administrative Tribunal (NCAT), and must retain them pending resolution. See the NSW Government’s pawnbroking guidance.

NSW Government also states that a buyer does not acquire title to goods sold without the owner’s consent or necessary authority. That statement is specific to NSW and should not be treated as the rule elsewhere; see the same NSW guidance.

The right next step depends on where you live, the watch’s value, whether it can still be recovered, and what outcome you are seeking.
| Route | When it may help | What to check |
|---|---|---|
| Written demand to the shop | As a direct first step to request the watch’s return or compensation. | Keep the demand, attachments, delivery proof, and the shop’s response. |
| Police and pawnbroker process | If the watch may be held by a pawnbroker or was transferred without permission. | Ask local police what report and recovery process applies; required notices and timelines vary by jurisdiction. |
| State or local consumer-protection office | If you want to report the business or seek help resolving the dispute. | Check the agency’s role and whether it offers complaint handling or mediation. The FTC accepts reports at ReportFraud.gov, but says it does not resolve individual complaints. |
| Small claims or other court action | If direct efforts fail and you need to pursue a legal remedy. | Check local eligibility, value limits, deadlines, filing steps, and whether the court can order return of the specific watch rather than award money. |
For a high-value watch, disputed ownership, an active pawn transaction, or a shop that refuses to cooperate, a local attorney or legal aid service can assess your options and whether urgent court action is available. The applicable claim, damages, and remedy depend on local law and the facts.
