What to Do if You Bought a Watch Later Found to Be Stolen

If a watch you bought may be stolen, stop using or transferring it, contact local police, preserve the sale records, and pursue a refund through the options available in your jurisdiction.

Stop wearing or transferring the watch, preserve all purchase and seller records, and contact local police promptly for instructions. Do not return it to the seller yourself. Then make a written refund request and ask your bank, card provider, marketplace, or a local consumer adviser what recovery options apply where you live. A buyer who acted in good faith may still have to give up the watch; ownership and refund rules depend on jurisdiction and whether the seller was a business or a private individual.

What to do first

  1. Stop using or transferring the watch. Do not wear it, sell it, gift it, alter it, or return it to the seller on your own. Contact local police as soon as the suspicion is credible, explain what you know, and follow their directions about surrender or safekeeping. Wales Citizens Advice advises contacting police rather than keeping the item or returning it to the seller; its UK-specific options include calling 101 or visiting a local police station. Use the appropriate police contact for your location. Citizens Advice Cymru
  2. Ask for a reference and custody instructions. Keep any police report, crime or property reference, and written instructions about where the watch should be held. Citizens Advice Cymru says police provide a crime reference number and property log number when the item is handed in. Do not assume a procedure from another jurisdiction applies to your case.
  3. Preserve the sale evidence. Save the receipt or bank record, original listing and photographs, seller profile and contact details, messages, payment confirmation, and packaging. Record the watch’s serial number and other identifying marks without altering them. Keep originals and copies, and note dates where possible.
  4. Write a dated timeline. Include when and where you bought the watch, what the seller said about it, how you paid, when you learned it might be stolen, and what you have since told police, the seller, bank, or marketplace.
  5. Contact the seller in writing. Give a concise factual account, include relevant purchase proof and the police reference if available, and request repayment. Avoid claims or threats that go beyond what you can substantiate.
  6. Ask your payment provider about recovery promptly. If you paid by card, ask the bank or card issuer whether a dispute or other recovery route may be available. Eligibility and deadlines depend on the payment method and local rules.

Citizens Advice Cymru recommends keeping purchase proof and police reference details when approaching the seller. The ACCC also advises retaining seller and listing information and proof of purchase. ACCC guidance on second-hand purchases

Can you keep the watch?

Not necessarily. Being unaware of the theft when you bought the watch does not itself establish that you own it. The original owner may retain title, and police may need to hold the watch or return it through a local process. NSW Government guidance puts the principle directly: “The buyer of stolen goods does not get title or ownership of the goods.” NSW Government: When you buy stolen goods

That is a statement of NSW law, not a complete rule for every country. Ask police how custody and any ownership claim will be handled locally. Do not resolve competing ownership claims by privately handing the watch to the seller or another claimant.

Possibly, but the route and legal entitlement depend on where the purchase took place, who sold the watch, how you paid, and the transaction details. Keep the refund request in writing and save the response.

If you bought it in Wales

Citizens Advice Cymru says a buyer who did not know the item was stolen should not get into trouble merely for buying it, and advises asking the seller for a refund. Its guidance says a buyer has a legal right to a full refund under the Consumer Rights Act 2015, including when the theft is discovered later. It also describes possible card recovery, alternative dispute resolution, and court claims. These are Wales-specific consumer guidance; check the rules and procedures for other UK nations or countries. Citizens Advice Cymru

Australian Consumer Law applies to business transactions. A sale by a private individual is generally treated as consumer-to-consumer, where contract law applies; the NSW Government recommends independent legal advice for a problem with a private transaction. ACCC guidance distinguishes business and private sales and notes that limited guarantees for private sales include title, undisturbed possession, and no hidden debts or charges. If a dealer or pawnbroker in NSW holds the watch

NSW has a specific restoration process for goods held by a pawnbroker or secondhand dealer. After a police report, a person claiming ownership may provide evidence or a statutory declaration. If police have no reason to suspect it is false or misleading, they may serve a Restoration Notice. The dealer then has 28 days to return the goods or apply to the NSW Civil and Administrative Tribunal, and must hold the goods while the matter is resolved. This procedure is specific to that NSW context; it is not a general process for ordinary private sales or other locations. NSW Government: When you buy stolen goods

If the seller refuses to repay you

  • Follow up with your bank or card provider. Ask about applicable dispute or recovery options and any time limits. A payment provider’s process is not the same as a guaranteed refund.
  • Use the marketplace’s dispute process, if applicable. Provide the listing, messages, payment proof, and police reference, and ask how it handles suspected stolen property.
  • Contact a local consumer advice service or consider ADR. The available body and process depend on your location and the seller type.
  • Get advice before a court claim. Check the local procedure, fees, deadlines, and evidence requirements. Citizens Advice Cymru cautions that court proceedings involve fees and recommends considering legal advice before taking that route.

Why the seller type and location matter

A watch bought from a business or dealer may be covered by consumer protections that do not apply in the same way to a private sale. Payment method can also change which recovery routes are available. Meanwhile, police, a pawnbroker, a marketplace, or the original owner may have custody or an interest in the watch. Tell local police who currently has it, and get jurisdiction-specific guidance before taking action that could affect the evidence or ownership claim.
